  4. Informa\u00e7\u00f5es de contato da pessoa que notifica a Empresa, incluindo endere\u00e7o, n\u00famero de telefone e, se dispon\u00edvel, endere\u00e7o de e-mail;<\/li>
  5. Uma declara\u00e7\u00e3o de que o notificador acredita de boa-f\u00e9 que o material n\u00e3o \u00e9 autorizado pelo propriet\u00e1rio dos direitos autorais, seu agente ou pela lei; e<\/li>
  6. Uma declara\u00e7\u00e3o feita sob pena de perj\u00fario de que as informa\u00e7\u00f5es fornecidas s\u00e3o precisas e que a parte notificante est\u00e1 autorizada a fazer a reclama\u00e7\u00e3o em nome do propriet\u00e1rio dos direitos autorais.<\/li><\/ol>\n\n\n\n

    Ap\u00f3s o recebimento da Notifica\u00e7\u00e3o de Viola\u00e7\u00e3o de Boa-F\u00e9 adequada pelo Agente Designado:<\/h3>\n\n\n\n

    1. para remover ou desabilitar o acesso ao material infrator;<\/li>

    3. que os infratores reincidentes ter\u00e3o o material infrator removido do sistema e que a Empresa encerrar\u00e1 o acesso do provedor de conte\u00fado, membro ou usu\u00e1rio ao servi\u00e7o.<\/li><\/ol>\n\n\n\n

      Procedimento para fornecer uma contranotifica\u00e7\u00e3o ao agente designado:<\/h3>\n\n\n\n
      1. Uma assinatura f\u00edsica ou eletr\u00f4nica do provedor de conte\u00fado, membro ou usu\u00e1rio;<\/li>
      2. Identifica\u00e7\u00e3o do material que foi removido ou cujo acesso foi desabilitado e o local onde o material apareceu antes de ser removido ou desabilitado;<\/li>
      3. Uma declara\u00e7\u00e3o de que o provedor de conte\u00fado, membro ou usu\u00e1rio acredita de boa-f\u00e9 que o material foi removido ou desativado como resultado de um erro ou identifica\u00e7\u00e3o incorreta do material; e<\/li>
      4. Nome, endere\u00e7o, n\u00famero de telefone e, se dispon\u00edvel, endere\u00e7o de e-mail do provedor de conte\u00fado, membro ou usu\u00e1rio, e uma declara\u00e7\u00e3o de que tal pessoa ou entidade consente com a jurisdi\u00e7\u00e3o do Tribunal Federal para o distrito judicial no qual o endere\u00e7o do provedor de conte\u00fado, membro ou usu\u00e1rio est\u00e1 localizado, ou se o endere\u00e7o do provedor de conte\u00fado, membro ou usu\u00e1rio est\u00e1 localizado fora dos Estados Unidos, para qualquer distrito judicial no qual a Empresa esteja localizada, e que tal pessoa ou entidade aceitar\u00e1 a cita\u00e7\u00e3o da pessoa que forneceu a notifica\u00e7\u00e3o da suposta viola\u00e7\u00e3o.<\/li><\/ol>\n\n\n\n

        Caso o Agente Designado receba uma contranotifica\u00e7\u00e3o, a Empresa poder\u00e1 enviar uma c\u00f3pia da contranotifica\u00e7\u00e3o \u00e0 parte reclamante original, informando-a de que poder\u00e1 substituir o material removido ou interromper a desativa\u00e7\u00e3o em 10 dias \u00fateis. A menos que o titular dos direitos autorais aju\u00edze uma a\u00e7\u00e3o judicial contra o provedor de conte\u00fado, membro ou usu\u00e1rio, o material removido poder\u00e1 ser substitu\u00eddo ou o acesso a ele restaurado em 10 a 14 dias \u00fateis ou mais ap\u00f3s o recebimento da contranotifica\u00e7\u00e3o, a crit\u00e9rio da Empresa.<\/p>\n\n\n\n
